1. Acceptance of Terms

By creating an account or using the ProLeveling application ("App", "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and ProLeveling LLC ("ProLeveling", "we", "us", "our").

2. Eligibility

You must be at least 13 years old to use ProLeveling. By using the Service, you confirm that you meet this age requirement.

If you are between 13 and 18 years old, you confirm that you have obtained parental or guardian consent to use the Service. ProLeveling reserves the right to request proof of consent and to terminate any account where consent cannot be confirmed.

3. Account Registration

To access the full features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your password confidential and not share access with others
• Notify us immediately of any unauthorized use of your account at consult@proleveling.app

You are solely responsible for all activity that occurs under your account.

4. Description of Service

ProLeveling is a football development platform that provides:

• AI-powered self-evaluation of football attributes
• Personalized 6-week training plans generated by artificial intelligence
• Progress tracking and performance analytics
• Educational football content
• Community features

The Service is provided "as is" and is subject to change at any time without prior notice.

5. Subscription and Payments

5.1 Free Tier

ProLeveling offers a free tier with access to core features at no cost.

5.2 Pro Subscription

A paid Pro subscription ("Pro Tier") is available at 5,000 FCFA per month (or the equivalent price displayed at the time of purchase in your local currency). The Pro Tier provides access to additional features as described in the App.

5.3 Billing

Subscriptions are billed on a monthly basis. By subscribing, you authorize ProLeveling to charge the applicable fee to your chosen payment method on a recurring basis.

5.4 No Refund Policy

All payments made to ProLeveling are final and non-refundable. We do not offer refunds, credits, or exchanges for any subscription fees, partial months, or unused periods. This includes but is not limited to situations where:

• You cancel your subscription before the end of a billing period
• You no longer wish to use the Service
• Your account is terminated due to a violation of these Terms

5.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.

6. Intellectual Property

6.1 ProLeveling Content

All content on the Service — including but not limited to the app design, source code, text, graphics, logos, icons, audio, and video — is the property of ProLeveling LLC and is protected by applicable intellectual property laws.

6.2 AI-Generated Content

Any training plans, evaluations, recommendations, analyses, and other content generated by the artificial intelligence systems within the Service are the exclusive property of ProLeveling LLC. By using the Service, you acknowledge and agree that:

• You have no ownership rights over AI-generated outputs
• You may use AI-generated outputs for your personal football development only
• You may not reproduce, distribute, sell, or commercially exploit AI-generated content without written permission from ProLeveling

6.3 User-Submitted Data

You retain ownership of personal data you provide (such as your name, profile photo, and self-reported physical attributes). However, by submitting data to the Service, you grant ProLeveling a worldwide, royalty-free, non-exclusive license to use, process, and analyze that data to provide and improve the Service, as described in our Privacy Policy.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to any part of the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scrapers to access or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Post or transmit any content that is harmful, offensive, or violates the rights of others
• Share your account credentials with third parties

8. Third-Party Services

The Service relies on third-party providers to function, including:

• Supabase — database and authentication
• Anthropic — AI language model powering evaluations and plans
• Resend — email delivery
• Make.com — workflow automation
• Vercel — hosting infrastructure

Your use of the Service is also subject to the terms and privacy policies of these providers. ProLeveling is not responsible for the practices of these third parties.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranty of any kind, express or implied. ProLeveling does not warrant that:

• The Service will be uninterrupted, error-free, or secure
• The training plans and evaluations produced will achieve specific athletic results
• Any content or information provided is accurate, complete, or current

ProLeveling is not a medical or sports medicine service. Consult a qualified professional before beginning any training program.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ProLeveling LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, personal injury, or property damage.

Our total liability to you for any direct damages shall not exceed the amount you paid to ProLeveling in the 12 months preceding the claim, or 5,000 FCFA, whichever is less.

11. Termination

ProLeveling reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

12. Modifications to Terms

ProLeveling reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.
